    Hildred is 99 years old; like most people her age, she has medical conditions. Arthritis, hypertension, macular degeneration, hyperthyroidism and the most critical, congestive heart failure (CHF).

    But when you visit her, you’d never know it. She fills her bird feeders outside her beautiful apartment in Windsor Park, a Covenant Retirement Community and takes daily walks around the grounds. She writes poetry, creates artwork that adorns her walls, is still active in the book club she started, and has lunch and dinner with friends.

    She doesn’t look, or act, her age; more like someone at least 20 years younger.

    What has kept Hildred from being admitted to the hospital, where the average Medicare cost of treating CHF is $ 20,000, is a small care team – her daughter, a doctor who didn’t just “automatically” admit her when her CHF symptoms worsened, and a nurse and nursing aide who manage and monitor her medications and overall health conditions every day. Her home care typically costs $ 152 per week.

    If everyone had care like this, Medicare estimates its savings from hospital readmissions alone would be $ 17 billion annually. In fact, it is now rolling out a national program that will support better communication among aftercare providers and, starting next year, penalizing hospitals that underperform on hospital readmission rates.     “I think I’ve done it myself,” says Hildred, the very independent former teacher, mother of two, grandmother of four and great grandmother of five, when first asked how she’s been able to stay out of the hospital. But then, she admits, “Well, I have to give the nurses some credit. If there is anything wrong, they’re onto it immediately. They come to my apartment every day and also call me. They have been very good in keeping a relationship with how I’m feeling and noticing things that may need attention.”

    CHF is a chronic illness, one of three leading causes of hospitalization among the elderly. “It goes from stabilized to recurrence of symptoms very rapidly,” explains her registered nurse, Rosann Forni of CovenantCare at Home.

    In April, Rosann noticed that Hildred had shortness of breath, swelling in her legs, fluid retention and changes in her blood pressure. She immediately contacted Hildred’s daughter Carol, who lives an hour’s drive away, and then her physician, Dr. Kenneth Ha.

    “When she came in, I suspected CHF and confirmed that,” explained Dr. Ha. “We could either admit her to the hospital or try to treat her as an outpatient. In cases like this, hospitals can be almost counterproductive at times. For the geriatric population, there can be issues with increased confusion of the patient, and a prolonged stay can lead to physical problems and the risk of infection. So, initially I decided to treat her with medications.”

    Dr. Ha said that having home health care was ideal for Hildred’s situation. “For the next month or two, there was a good amount of going back and forth” with Rosann, adjusting Hildred’s medications and monitoring her conditions every day.

    In fact, says Dr. Ha, “Medication monitoring is huge in treating the geriatric population. At first, patients are resistant to having help because they want to retain their independence. The first step is getting them to realize that they need someone to help them. Otherwise they’ll say, ‘I’ll take care of myself now; I’m not going to pick up the phone and call you.’ But they could be very sick.”

    Dr. Ha relies on home health care to monitor his patients. “I just feel like it’s almost impossible to deal with elderly patients the way you should without it. Rosann is my eyes when I can’t be there,” he said.

    Hildred’s CHF is in remission now. This has enabled her to stay in her Windsor Park apartment, where she has lived for 22 years. “Of course, you want to stay in your own home,” she says. And, countless studies show that the elderly recover faster and enjoy a better quality of life if they are able to stay at home.

    “It is a wonderful life here at Windsor,” she concludes.

    Malman Law announced Friday that it successfully settled a record number of nursing home-related cases in 2011.

    Thanks to the tireless work of its highly focused Nursing Home Team (including four attorneys, three paralegals and several administrative staffers), the targeting of elder care facilities guilty of neglect, physical abuse and worse has “become a huge part of our firm,” according to founding partner Steven Malman.

    “This is a complicated and emotional issue,” the attorney said. “But the bottom line is this: There are over 5,000 nursing homes in Illinois and the majority is centered in and around Chicago. They’re run by a handful of families and large corporations that manage these facilities as cheaply as possible to generate the biggest profit, and as a result, in many cases, the patients are truly suffering.”

    Malman cited “an overall system of incredibly poor care” and blamed drastic Medicare and Medicaid cuts over the years that have “reduced the profitability of these homes to the point where the only way to be profitable is to cut staff.”

    “This really stems from a lack of money provided by the government,” he noted. “But the truth is, most of these homes are putting profitability first.”

    Combined with various societal and economic factors – including longer life spans and a nursing home population that’s exploding as the elderly relocate to the dense Chicago area to be closer to their kids – it’s a “recipe for disaster,” the attorney added. Poor training, insufficient supplies and generally substandard care have left elderly patients to suffer everything from bed sores and malnutrition to physical and sexual abuse.

    It’s also encouraged Malman Law to create its Nursing Home Team, which according to Malman has quickly pushed the firm to the top of Chicago’s heap in terms of nursing home-related lawsuits filed and successfully settled.

    “We opened a record number of nursing home cases this year, and resolved more of them than ever before,” Steven Malman said. “There were stretches where we were in mediations and successfully resolved three or four cases a day.”

    After learning about the “ongoing problem” at many chicago-area nursing homes about seven years ago, his firm “started realizing what we could do in this area,” Malman added. Soon, Malman Law made a name for itself by winning half-a-dozen other high-profile nursing home-related cases, and this year it officially christened its dedicated Nursing Home Team – including one attorney who has focused exclusively on nursing home cases over the past seven years and another who previously worked as a defense attorney for elder-care facilities.

    “It’s like we’re in a football game, and now I have the other team’s playbook,” Steven Malman noted of that former defense attorney. “We know everything they’re going to try because we have her on our side.”

    Not every nursing home is poorly run, the attorney said, and many obviously put their patients’ wellbeing first. But there are many out there that “just don’t care,” he added, and the formidable Nursing Home Team packs exactly the right legal punch to take on a “corrupt nursing home system that’s causing so much hardship and pain for so many people.”

    It proved that in 2011, he said, and will continue to do so in 2012.

    “I expect the Nursing Home Team will be very busy next year,” Steven Malman said. “This is a problem of epidemic proportions. Not only are so many of these nursing homes poorly run, but they have significant legal resources to cover their tracks. You need significant legal resources to counter that, and that’s precisely what our Nursing Home Team offers.

LifeStorage is also experimenting with online unit auctions. Currently, three LifeStorage locations have units online up for bid. For LifeStorage, it’s a new way to auction that can potentially reach a much larger audience of bidders.

    “We’re trying to see what the market is like for online bidding. It’s a different way of doing things and we’re researching it to see how effective it is. For bidders, there are pros and cons. Not having to leave your desk is definitely a plus, but you don’t quite get the same experience as you do in person. You can’t tell as much about the contents of a unit from a computer,” said Matt Clark, Vice President of Operations for LifeStorage, and a 12-year veteran of the storage industry and auction process.

    The auction is the worst-case scenario of renting a storage unit, but also one of the more intriguing aspects of running a storage company. If a tenant is 30 days late on their rent, a lien is placed on the storage space and payment is demanded. LifeStorage tries to give its customers every opportunity to make payment, so while the process starts within the first month after a renter becomes delinquent, units aren’t auctioned until a renter is at least two months late.

    “We notify them via mail, phone, attempt to contact them by email if provided, and also post an advertisement of the auction in a local newspaper twice before the auction is held. We make regular phone calls until the moment a unit is sold. At LifeStorage, we do everything within our ability to contact our customers to try and work out a payment plan before we sell their items at auction. It’s only a last resort that we hold public auctions to reclaim a rental space. We also do everything within our power to have personal items returned, like photos, birth certificates, wedding albums, anything of a very personal nature, we try very hard to convince the buyers to return those possessions, and no other company does that. We have a heart,” Clark said.

    Storage auctions have become something of a fad of late, with multiple television shows covering the subject. The auction process is fairly straightforward. Illinois has very stringent guidelines that LifeStorage follows regarding restrictions, notifications and advertisements that need to be placed before an auction is held. Once on site, the rules are announced to bidders, who are then allowed to view a unit’s contents for about five minutes without actually entering the space. Then the live bidding takes place and the unit is sold to the highest bidder.

    “It surprises me, even after twelve years, what some of the regulars can see. Jewelry boxes hidden in the back, boxes of brand new merchandise, antiques the people that are experts at this have a source to resell all of the stuff they find. They have a system and it’s really impressive how they can make a living at this,” Clark said.
